Obligations for Marketplace seller

Starting in 2022, if you sell your products in Germany and/or France, operators of Marketplaces must ensure that you are fully complying with the Extended Producer Responsibility (EPR) in these countries. The Marketplace will therefore collect and validate your EPR registration number(s).

If you cannot prove your EPR compliance to your Marketplace, you can expect the following actions:

Germany: Marketplace will be obliged to suspend your non-compliant listings under the relevant EPR product categories:
Packaging: all listings from July 1, 2022
Electrical and Electronic Equipment (EEE): all listings falling under EEE from January 1, 2023
Batteries: currently not in scope within German regulations

Whoever puts the sales packaging into circulation first, is the “initial distributor” according to the Packaging Ordinance (as of 1 January 2019 Packaging Act) and is therefore obligated to contract this with a packaging scheme (“Duales System”). It is not just cardboard packaging that must be licensed but also films, bubble wrap, natural materials, glass etc. This does not just apply to large companies but also to small manufacturers and distributors of goods, even if they are not using their own online shop for sales but platforms such as Amazon, eBay or DaWanda. Even the smallest quantities have to be licensed. Anyone who does not meet this obligation is threatened with warnings and penalties of up to EUR 100,000.

The Packaging Act

The Packaging Act took the last parliamentary hurdle on 12 May 2017 and came into effect on 1 January 2019. The regulation contains several important changes for manufacturers and distributors. 

On 20 January 2021, Germany’s Federal Cabinet approved a new Draft Law transposing the Single Use Plastics Directive (EU-Plastics Directive 2019) and the Waste Framework Directive into the Packaging Act (VerpackG). This is intended to bring the Packaging Act into line with the current EU directives and to improve its enforcement. The law came into force as of 3 July 2021.

  1. Initial distributors
    If you are the first to fill packaging with goods and distribute them to private end consumers, you are the initial distributor.
  2. Registration
    Obtain information and register at www.shop.landbell.de in just two steps.
  3. Agreement
    Conclude your participation agreement straight after registration. For an annual flat rate of EUR 75 (plus VAT) you license up to 150 kilograms of paper/paperboard/cardboard (equals roughly 400 medium dispatch boxes) for Germany with Landbell EASy.
  4. Quantity reports
    You really easily submit your quantity report through the EASy shop retrospectively. You simply enter the quantities you put into circulation per material type (paperboard, paper, cardboard, glass, aluminium etc.).
  5. Payment
    You can conveniently pay by credit card, PayPal or on account.
